NY-13: GOP Cong. Vito Fossella Arrested

Rep. Vito J. Fossella (R-N.Y.) was arrested overnight in Alexandria and charged with driving while intoxicated, court records showed today.

Fossella is scheduled to appear in Alexandria General District Court on May 12 for an advisement hearing, the records said.

No other details were immediately available.

Fossella was elected to Congress in a special election to represent the 13th Congressional District of New York in November 1997, according to a biography on his Web site. The district includes Staten Island and the Bay Ridge, Dyker Heights, and the Bensonhurst and Gravesend neighborhoods of Brooklyn.

Being arrested for a DUI isn't necessarily a political death-knell for an incumbent -- but neither is it terribly good news, particularly when that incumbent is potentially vulnerable. Fossella won reelection in 2006 with about 57 percent of the vote, so he isn't necessarily in terrible shape coming into this election cycle. However, New York's 13th congressional district, which he represents, tends to lean about 1 point more Democratic than the nation as a whole in presidential elections, so this year being a presidential election year doesn't augur particularly well for Fossella's hopes. Throw in a DUI and this race may now be on the map.

At this point, there are a couple of Democrats looking at this race: 2006 nominee Steve Harrison and Brooklyn City Commissioner Domenic Recchia. Recchia, in particular, looks like a formidable candidate, having raised more than $350,000 to this point. In fact, Recchia has more in the bank than Fossella as of the last filing period. So definitely chalk this up as one to keep an eye on...

Fossella is a GOP fossil, probably as reliable a Bush Conservative as you'll find in the COngress.

His District in NYC is in Staten island, home of police and sanitation and firemen and other upper-middle class, solid Conservative neighborhoods.

It's kind of like living in White Maryland or Virginia down there.

Agreed.  And yet threads like this get 10-30 comments, while the primary threads get 200+.

Anyway, I do think this will mean Fossella either loses or retires this cycle.

Well it may make a difference.

Is it his first offense (ie does he have priors in NY or elsewhere)

Is there a probation before judgment program in VA

Will he do any jailtime

Will a VA judge go easy on him if he pleas open

Will the Commonwealth go easy on him

Political favortism/speacial treatement may hurt him

It's too bad that both of our candidates are from Brooklyn.  I think we would have a much stronger chance in this district if we ran a Staten Island Democrat, as most of the district's population lives in Republican-leaning Staten Island, not the Democrat-heavy sliver that is in Brooklyn.

I don't think i'd call Domeic Recchia a formidable candidate, he doesn't even live inside the district. Steve harrison does live in the district but only in the small sliver in brooklyn whic accounts for about 15% of the votes cast, to win this seat we really need a candidate from SI.

BTW really great to see this kind of story front paged, i agree with Kobi. Shame that this kind of diary'll only attract a few comments, whilst a diary about Barack Obama being a known carcinogen or Hillary Clinton killing puppies or any other inane, irrelevant, trivial drivle that has come to infest the blogs i loved to read so much during the 06 election (that includes you too Kos.), will atract a barrage of distructive commenting. I'm encouraged by this, i know this isn't going to turn into a blog like SSP but its good!!

I still don't understand how a guy as conservative as Fossella has won as convincingly as he has in a marginal district like this.  I'd love to hear the lowdown from anyone in the District.  

Regardless, here's hoping this bum gets kicked to the curb.  DWIs are no joke.  I'll be interested to know what his blood alchohol level was.  That could make this even worse for him if it's particularly high.

As I grew up and just recently moved from the Brooklyn part of this district, I can tell you that Fossella wins by appealing to some very jingoistic, blue collar types, especially in Staten Island and especially after 9-11. He's a hawk that wraps himself in the flag and doesn't hesitate to play the fear card. BTW Recchia can't even vote for himself in this district. Harrison has strong ties in both Brooklyn and Staten Island.

I agree this is a good post.  Congressional races must be watched.

Fosella can lose, remember we won in PA-07 in Weldon's seat (which is my home) by 12 because we ran a good candidate and Weldon had been involved in corruption and had not run many good campaigns.

We can beat him with this Councilperson.

Sadly Kerry lost the seat, while Gore carried it.

If Clinton is the nominee their will be huge coattails as she will probably will carry the seat by 20.

I'm not so sure either wins this district. Clinton was weak here even when she ran for Senate and i think even she will do better than Obama

but absent a Fossella-like character, the seat is in play. Recchia is questionable. He doesn't actually live in the district and conventionial wisdom is the Democratic nominee should come from Staten Island and not Brooklyn as the Democrat almost always wins Brooklyn anyway.

still needs updating. Pollster.com's latest poll has Hillary down in MN. NC is tied according to the latest poll so that should be taken out of the McCain column. Yeah I know, Obama won't win NC but rules are rules no?

But Gore did carry the seat by 52-44 while Bush won it 55-44 in 2004.

There is no way Hillary can't win the seat.

Frankly with gas at 3.75 a gallon I dont know how the Republicans have a prayer.

As a NY'er who grew up in Jersey (which is more similar to SI than Manhattan), my gut reaction is that DWI would not be an intrinsically heavy blow, especially in a community where machismo is prized.

We're used to scandals that relate directly to the job. Kerik, McGreevy, Spitzer. Maybe parents would hold it against him, though.
