The first Democratic Senator has broken ranks on Roberts

Sen Max Baucus, D-Montana has announced he will vote to confirm Judge Roberts as Chief Justice of the US Surpreme Court.  Rumor has it the Sen Ben Nelson is close to doing the same but as of now Baucus is the only one.

On the Harry Reid article, it sounds as if Ben Nelson has already decided to vote to confirm John Roberts

I think Nelson will vote for him but I have not read the CNN article to see if Nelson has actaully made an announcement so far Baucus is the only one I know to announce, however I will read the article and see.

Roberts vote (none / 0)

John Roberts will be confirmed by an overwhelming margin. A fight is really not worth it at this time. Roberts has come across very well.

Save the fight for the next nomination.

A fight is one thing. But a heavy vote against Roberts puts the Dems on record as opposing a nominee who refuses to answer questions and who has a suspect paper trail, not to mention very little judicial experience to qualify him for the chief post. The Republicans wouldn't back down and change their votes just because the wind is blowing the other way.

Let them have Roberts replace Rehnquist, a conservative for a conservative. But When it comes to the new replacement for O'Connor, Our side has to kick some real ass.

Let them have nothing... make them earn it.  Roberts  did not earn the post, he refused to answer in a any serious way the countless questions we should all care about:

  • Civil Rights
  • Right to Privacy
  • Right to Choose
  • Right of the Federal Government to Protect the Environment

If the situation were reversed Republicans would not "give us" anything; in fact, they would be fighting us tooth-and-nail to get their way.  We should pay in kind.

And yes, they should have to earn the O'Connor seat, too.  We've already given them too much -- we've practically let them have the entire country already.
